Terms of service.
1. Acceptance of Terms
By engaging YTpodcasting ("we", "us", "our") for any services, or by using this website, you ("client", "you") agree to the terms below. If you do not agree, please do not proceed with an engagement.
2. Services Offered
We provide podcast and YouTube production services, including strategy, guest research, title and thumbnail packaging, post-production, publishing, and performance analysis. The specific scope for your engagement will be defined in a separate service agreement or statement of work.
3. Service Engagement
Engagements typically run on a monthly retainer with a minimum initial term agreed in writing. Work begins after the first payment is received and onboarding is complete. Either party may pause or end the engagement according to the notice period specified in the service agreement.
4. Payment Terms
Fees, payment schedules, and invoicing cadence are set out in your service agreement. Invoices are payable within the window stated on the invoice. Late payments may result in paused work and, at our discretion, a reasonable late fee. Payments made are non-refundable except as described in our Refund Policy.
5. Intellectual Property
Upon full payment for the relevant deliverables, you own the final published episodes, videos, and associated assets created specifically for your channel. We retain the right to reference the work in our portfolio, case studies, and marketing unless otherwise agreed in writing. Any proprietary frameworks, systems, research tools, or internal documents we use remain our property.
6. Service Limitations and Expectations
We commit to the quality of our craft and the consistency of our process. We do not, and cannot, guarantee specific outcomes such as view counts, subscriber growth, revenue, or ranking. Results depend on many factors outside our control, including the underlying audience, topic, guest, and platform algorithms.
7. Account Access and Security
Where our work requires access to your accounts (YouTube, podcast hosts, analytics, etc.), you agree to grant the minimum necessary access and to maintain reasonable security practices on your end. We will handle all credentials in line with our internal security standards and remove access promptly when the engagement ends.
8. Confidentiality
We treat non-public information shared by you as confidential and will not disclose it to third parties except as needed to deliver the service (for example, to contracted editors or researchers under equivalent obligations) or where required by law.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or related to the services is capped at the total fees paid by you in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages.
10. Termination
Either party may terminate the engagement for material breach not cured within a reasonable notice period, or for any reason with written notice as specified in the service agreement. Fees for work completed prior to termination remain payable.
11. Governing Law
These terms are governed by the laws of India, without regard to conflict-of-laws principles. Any disputes will first be addressed through good-faith discussion and, if unresolved, through arbitration or the courts in Bengaluru, Karnataka.
12. Modifications
We may update these terms from time to time. Material changes will be communicated to active clients by email. Continued use of our services after an update constitutes acceptance of the revised terms.
